For some reason my 2d (yes I am using 2dimmidate) GUI is going under all my 3dmax meshes.
Is there some switch that I forgot or option that tells the engine that 2d should be rendered before the 3d scene?

Yes, you do that yourself
TVScene.RenderAll()
TV2DImmediate.DoSomething().
That'll do the trick:)
